1. Service Eligibility & User Accounts

SpellPic offers high-performance cloud GPU computing for deep learning-driven visual synthesis. By utilizing our Service, you confirm and warrant that:

• Age Requirement: You are at least 18 years of age (or the legal age of digital majority in your country of residence). Minors under 18 years of age are strictly prohibited from using the Platform.
• Account Integrity: You are responsible for safeguarding your login credentials and for all generation activities, prompt tokens, and credit consumptions occurring under your registered account.
• Synthetic AI Output Nature: Outputs generated by SpellPic are synthesized via algorithmic probability distributions and neural weights. They represent generative digital interpretations and do not constitute photographic proof of real-world events.

2. Subscriptions, GPU Credits & Refund Policy

Access to high-speed inference queues, 8K ultra-resolution renders, and 60fps cinematic video synthesis is managed through membership tiers and compute credits:

• Recurring Memberships: Subscription tiers (Weekly, Monthly, or Annual Pro Passes) renew automatically through your authorized application store account (Apple App Store or Google Play Store) unless cancelled at least 24 hours prior to the close of the active billing cycle.
• Compute Credits & Tokens: Generation credits represent a revocable, non-exclusive license to allocate cloud GPU processing power (H100/A100 clusters) for image and video synthesis. Credits possess no independent monetary value, are non-transferable between users, and cannot be redeemed for fiat currency.
• No-Refund Policy: Because cloud neural computation resources are permanently expended in real time during latent diffusion and motion tensor processing, subscription fees and consumed credit allocations are non-refundable, except where expressly mandated by consumer protection laws or store platform regulations.

3. Intellectual Property Rights & Commercial Licensing

We believe that creators should reap the full creative fruits of their vision:

• Ownership of User Inputs: You retain all proprietary rights in and to the custom prompts, text descriptions, and reference images you upload to the Platform.
• Commercial Licensing of Outputs: Subject to your compliance with these Terms and an active qualifying subscription, SpellPic assigns to you all its right, title, and interest in and to the image and video assets generated through your account, permitting commercial utilization (including YouTube production, marketing campaigns, print publication, and gaming media).
• SpellPic Platform Property: The SpellPic application code, brand trademarks, visual UI components, neural engine architecture, diffusion presets, and motion vector algorithms belong exclusively to SpellPic Inc. and its licensors.

4. Acceptable Use Policy & Absolute Redlines

To preserve a secure, lawful, and ethical creative ecosystem, you explicitly agree NOT to use SpellPic to generate, upload, or disseminate:

• Child sexual abuse material (CSAM) or any content depicting, encouraging, or facilitating harm against minors.
• Non-consensual intimate imagery, synthetic revenge porn, or unauthorized non-consensual deepfakes of real-world individuals.
• Extreme violence, gore, tactical instructions for self-harm or suicide, or blueprints for biological and explosive weapons.
• Content intended to defame, harass, stalk, or promote hatred and violence against protected classes.
• Infringements upon third-party copyrights, registered trademarks, or publicity rights without proper authorization.
• Automated scrape bots, denial-of-service (DDoS) vectors, or unauthorized attempts to extract underlying neural model weights or reverse-engineer binary packages.

Violation of these safety redlines results in instant account termination, forfeiture of unused credits without refund, and reporting to relevant legal authorities where required by law.

5. Warranty Disclaimer & Limitation of Liability

The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis. SpellPic disclaims all warranties, express or implied, including merchantability, non-infringement, and fitness for a particular artistic purpose.

In no event shall SpellPic Inc., its officers, employees, or cloud compute partners be liable for any indirect, consequential, special, or exemplary damages—including loss of profits, data corruption, or business interruption—arising from your use of or inability to use the platform.

6. Termination & Account Erasure

You may discontinue your usage of SpellPic at any time. We reserve the right to suspend or permanently terminate your account without advance notice if you materially breach these Terms or engage in fraudulent activities.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and interpreted under applicable laws governing digital commercial contracts, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved initially through good-faith negotiation, and if unresolved, through binding individual arbitration. You agree to resolve claims strictly on an individual basis and waive participation in class actions.

8. Modifications to Terms

We reserve the right to revise these Terms periodically to accommodate new generative features or regulatory updates. Revisions will be published on this page with an updated effective date. Continued interaction with SpellPic signifies your acceptance of the amended terms.
